OSHA Helps Workers Concerned About Asbestos Exposure

Monday, August 23, 2010 by Scott Hendler
For more than 25 years asbestos has been well-known to cause serious lung diseases, including mesothelioma.    The Occupational Safety and Health Administration (OSHA), part of the U.S. Department of Labor (DOL), is the federal agency responsible for health and safety regulations in maritime, construction, manufacturing, and service workplaces---many of which used asbestos in their operations and facilities.

OSHA has specified how employers in these industries must deal with asbestos exposure on the job.  The industries specifically regulated include construction, shipyards, and any general industry that exposes workers.  Mine workers have another agency just for their industry.

If you work in any of these industries, make sure you use all provided protective equipment (OSHA-approved respirators is one example) and stick precisely to recommended workplace practices and safety procedures.

If you are concerned about asbestos exposure on your job, talk with other employees. Discuss with your employee health and safety representative and with your employers. Contact OSHA for more information or to conduct an inspection. Look up “United States Government” in your phone book (under “Department of Labor”). Or find your local/regional office on the OSHA website.

If you've received a mesothelioma diagnosis, you may also be eligible to receive compensation. Speak with one of our qualified mesothelioma trial attorneys as soon as possible. We have helped many clients receive the settlements they deserve for corporate misconduct regarding asbestos and other dangerous substances. Call us at 800.443.6353.

Some Pericardial Effusion Causes May Lead to a Lawsuit

Tuesday, August 10, 2010 by Scott Hendler
Malignant mesothelioma, an asbestos-related form of lung cancer, causes many difficult symptoms in those who develop it, often including pericardial effusion.  Late-stage patients may experience swelling in the chest area or the abdomen, coughing, loss of muscle tone, fatigue, chest pain and many other symptoms.  Because it is such an aggressive and difficult-to-treat disease, choosing your care team is critical.   Make sure they understand mesothelioma and how and when to perform various procedures and administer certain types of drugs.

You may also be eligible to receive compensation for your suffering. At HendlerLaw we have a history of successful mesothelioma litigation in which we've won significant settlements for our clients.  We will help you analyze the facts of your situation and make a decision as to whether you and your family may benefit from working---at no charge to you---with one of our mesothelioma trial attorneys.  Don't wait.  Call us 24/7 today at 800.443.6353.

What Does Asbestos Look Like?

Wednesday, August 4, 2010 by Scott Hendler
How do you identify asbestos? This question takes on critical importance for those who previously worked or are working in certain industries and those who work and/or live in older buildings or older homes. Asbestos exposure is the only known cause of a ravaging disease known as mesothelioma lung cancer that so far is fatal and incurable.

Many workers in certain industries were likely to have been unknowingly exposed to asbestos because they did not know how to recognize it in their work. According to the US Government Cancer site, industries that exposed workers to a high risk of asbestos exposure include shipbuilding, "asbestos mining and milling, manufacturing of asbestos textiles and other asbestos products, insulation work in the construction and building trades, and a variety of other trades. Demolition workers, drywall removers, asbestos removal workers, firefighters, and automobile workers also may be exposed to asbestos fibers. Studies evaluating the cancer risk experienced by automobile mechanics exposed to asbestos through brake repair are limited, but the overall evidence suggests there is no safe level of asbestos exposure."

In the case of older buildings and homes today, it pays to ask the question: what does asbestos look like? Watch for crumbling coatings on heating and cooling ducts and insulation on hot water pipes. There may be loose asbestos dust inside air vents as well. And if your home has asphalt and fiber-reinforced-cement siding shingles that were installed before 1978, you must exercise great caution when refurbishing and rehabbing. It wasn't until the late 70s that manufacturers and mining companies had to start observing general warnings about the dangers of asbestos---even though those dangers had been well known long before that.

The history of asbestos is long and full of reports of people becoming sick from being exposed. Yet it's only in the last decade or so that victims have been able to find employers and others legally at fault for having negligently exposed people to such health dangers. The record of success of mesothelioma lawsuits is growing. If you are being treated for mesothelioma, call us as soon as possible. We will help you review the facts of your situation and make a decision about whether it might make sense to file a case to possibly recover compensation. Our phone line is open 24/7 and we will be glad to answer your questions and guide you through the legal process once you decide to file. 800.443.6353.

Which Industries Are Involved in Mesothelioma Lawsuits?

Wednesday, July 21, 2010 by Scott Hendler
Mesothelioma is an aggressive form of lung cancer, the effects of which can include muscle wasting and fatigue (cachexia) in later stages. And at this point in time, the disease is still incurable. The only known cause of mesothelioma is asbestos exposure at some time during the patient's life---often while working where asbestos fibers were freely present.

A variety of manufacturing, mining and service companies have become involved in mesothelioma lawsuits in the past ten years or so. Some of those companies whose workers have had an increased incidence of mesothelioma and other asbestos-related diseases include:
  • manufacturers such as UNARCO, Johns-Manville, and Philip Carey
  • service stations where workers installed or repaired brakes or clutches
  • manufacturers that are indirectly involved with asbestos products such as Squibb, P&G, Carborundum, Ford, General Motors, Hercules, Hoffman-LaRoche, Merck
  • naval and other shipyards
  • oil refineries such as Chevron, Exxon, Mobil
  • construction industry jobs
If you've ever worked in one of these or a similar industry and have been diagnosed with mesothelioma, be sure when you are choosing a doctor that you find one who is very familiar with this disease and who keeps up with the latest research developments. The state of knowledge changes daily as more and more resources are dedicated to trying to understand and fight this killer affliction.

And don't hesitate to speak to one of our experienced attorneys about your legal right to potentially receive compensation for your illness. What About Pericardial Effusion in Mesothelioma?

Sunday, July 11, 2010 by Scott Hendler
An accumulation of fluid around your heart may be a sign of serious disease, or it may be a way your body reacts to an injury. Called pericardial effusion, causes can be quite different but usually fall into two main categories: underlying disease (cancer is a common cause) or trauma, as in injury or post-surgery.

Malignant mesothelioma is a fast-moving form of lung cancer that so far has a poor prognosis. The earliest noticeable signs might be confused with pleurisy symptoms---cough, chest pain, difficulty breathing---so it's important to see a doctor when you develop these types of symptoms. Early diagnosis means doctors may be able to use more aggressive treatments to extend survival times. Pericardial effusion is just one of the many signs that may develop in later stages of mesothelioma. Others might include abdominal fluid retention, cachexia (general debility, muscle wasting, losing weight) and more.

Because this disease is so aggressive, it is critical to get the best informed and most understanding doctors you can find. And because asbestos exposure is the foremost cause of mesothelioma of all types, it's important to do a thorough review of your personal history to see whether you may have been exposed and may have a right to recover compensation by filing mesothelioma litigation. We at HendlerLaw can help you explore your history and understand your options. Call us day or night at 800.443.653.

Peritoneal Mesothelioma Always Associated with Asbestos Exposure

Thursday, July 8, 2010 by Scott Hendler
Malignant mesothelioma is a rare but aggressive cancer that usually begins in your chest cavity, but it may also begin in your abdomen where it is called peritoneal mesothelioma. Unfortunately, it is very difficult to correctly diagnose peritoneal mesothelioma early on because of the lack of definitive symptoms. In later stages you may begin to accumulate a large amount of fluid in your abdominal cavity---called ascites. Treatment for peritoneal mesothelioma will depend on the type you have (several types have been identified such as biphasic and cystic---which is considered somewhat less aggressive) and the stage, but it normally consists of some combination of chemotherapy with pemetrexed and cisplatin, and surgery to reduce the tumor and remove cancerous cells.

No natural causes of mesothelioma in the peritoneum have yet been identified, regardless of the type. This disease has so far always been found to be associated with asbestos exposure at some point in the patient's life. It may originate in the abdomen or it may also develop from pleural mesothelioma cells migrating into the peritoneum.

Regardless of how mesothelioma begins, you deserve the best medical care. And you deserve the best mesothelioma legal advice you can obtain. Call us at HendlerLaw and we will help you review your history to identify potential sources of exposure to asbestos. Then we will advise you of your legal rights and help you decide whether to file a lawsuit---at no charge---to possibly recover compensation. 800.443.6353.

Caution Advised on Using Heated Chemotherapy for Peritoneal Mesothelioma

Wednesday, June 30, 2010 by Scott Hendler
Though some studies have been published stating that the combination of surgery and heated chemotherapy is effective for improving survival times for malignant peritoneal mesothelioma, a recent paper questions those conclusions. It states that the studies were flawed and patients cannot in fact expect longer survival times when treated with surgery to reduce tumor size combined with heated chemotherapy applied to the abdominal cavity (peritoneum).

Mesothelioma, a rare but aggressive form of cancer associated with asbestos exposure, most often occurs in the linings of the lungs (pleura) but can also occur in the linings around the heart (pericardium) or the peritoneum. Symptoms of mesothelioma in the pleura or pericardium can be cough, chest pain (pleural effusion causes fluid in and around the lungs), and shortness of breath. Symptoms of peritoneal mesothelioma are likely to be weight loss, cachexia (muscle wasting), abdominal pain and swelling (ascites). Treatment is often not begun early because these symptoms don't usually appear until the disease is at a late stage.

If you believe you may ever have been exposed to asbestos, make sure your doctor understands the signs and symptoms of mesothelioma. The earlier you are diagnosed properly, the more likely treatment can prolong survival. And don't hesitate to contact a qualified mesothelioma cancer attorney for information on your legal rights to potentially receive compensation if you develop mesothelioma. We are here to help. 800.443.6353.

Expensive Asbestos Removal Bill

Friday, June 18, 2010 by Yahaira Quezada
Asbestos is everywhere, including a run-down building that formerly housed a local historical society in Pennsylvania.  The building, owned by the non-profit historical society will be demolished because of the society’s inability to pay for proper maintenance.  The demolition will cost Washington County officials about $250,000.  The excessive cost is due to the fact that the structure is contaminated with asbestos.  Special precautions must be taken whenever asbestos is removed from any asbestos containing structure.  According to the EPA, up until the 1970s, many types of building products and insulation materials used in homes contained asbestos.  Disturbed asbestos-containing products such as insulation, fireproofing and acoustical materials are among the main sources of asbestos exposure.   The removal of asbestos posts potential health risks for many people in the area, if done incorrectly.

Inhaled asbestos fibers can cause serious health problems.  Asbestos is linked to diseases that include asbestosis, lung cancer and mesothelioma.   The American Cancer Society lists exposure to asbestos as the main risk factor for developing mesothelioma.  Most people that develop mesothelioma have worked in jobs where they breathed in asbestos fibers at some point in their lives.  Mesothelioma can take 25-40 years to develop after the initial asbestos exposure.

The truth about asbestos exposure has been known and mostly hidden from the American public since the early 20th Century.  If you or anyone close to you has developed the disease, chances are it is due to asbestos exposure at work or home.  HendlerLaw, a specialized mesothelioma cancer law firm has successfully litigated many asbestos lawsuits against manufacturers of asbestos containing products.  Contact us with no obligation at 1-800-443-6353.

Photodynamic Therapy Can Speed Relief in Mesothelioma

Friday, June 11, 2010 by Scott Hendler
Mesothelioma lung cancer is an aggressive and deadly disease in which patients may develop tumors in various parts of the body. Sometimes tumors can block important body functions. For example, a tumor may be growing in such a way that it blocks an airway, causing the patient to have great difficulty breathing.

Photodynamic therapy for lung cancer is becoming an accepted treatment for mesothelioma tumors. It consists of a laser light interacting with photosensitive material injected into the body in order to reach and kill or reduce a tumor. One of its main advantages is that it works quickly. Airway blockages, for example, might be relieved in as little as a few days.

Photodynamic therapy (PDT) has several other advantages in addition to speed:
  • PDT can work in places where doctors cannot perform surgery (say, in the trachea, which leads from the voice box to the lungs)
  • PDT, unlike radiation and chemotherapy, can be repeated without significantly harming the patient
  • PDT has few side effects (unlike many chemotherapy drugs such as carboplatin)
Talk to your doctor to see if PDT might be helpful in your case.

Pericardial effusion causes can be benign or malignant

Monday, May 31, 2010 by Scott Hendler
If your body starts to retain fluid in the tissues around your heart (pericardial effusion), you may feel discomfort anywhere from mild to severe depending on situation. Pericardial effusion causes can be either benign and malignant, so it's critical to have an experienced doctor evaluate your condition as soon as possible.

A recent study showed that doctors may be able to tell whether an effusion is benign or malignant by measuring the thickness of the pericardium and looking for enlargement in your lung. Malignant disease generally results in a significantly greater thickening of this lining surrounding your heart. This may help doctors find a problem without more invasive procedures.

Malignant mesothelioma, the asbestos-related lung cancer, can begin with signs that are like pleurisy symptoms---dry coughing or pain on inhaling or exhaling (but not much in between). Your body may try to fight these by accumulating fluid around your lungs--a percidarial effusion, which might even make your symptoms feel better temporarily. But if you should ever experience signs like that, don't wait. See a doctor immediately.

Need Mesothelioma Legal Advice?

Monday, April 26, 2010 by Scott Hendler
If you have mesothelioma, hopefully you've received solid advice on choosing your care team. It's critical to have experienced medical professionals who understand the signs, symptoms, and typical progress of this ravaging disease. Mesothelioma has lung cancer effects that can result in a host of symptoms. Mesothelioma Causes: No Mystery

Friday, April 23, 2010 by Scott Hendler
Mesothelioma is a very difficult disease--an aggressive form of lung cancer, the effects of which are still usually fatal despite years of research into cures. There are not a great many mesothelioma causes: other than extremely rare cases, asbestos exposure at some point in a person's life is the main culprit among mesothelioma causes.

Patients who develop mesothelioma may experience any number of symptoms. They can include abdominal fluid retention (abdominal ascites), or pleurisy symptoms such as coughing, sudden and intense chest pain, rapid shallow breathing, or difficulty breathing (caused by pleural effusion--fluid collecting in the space around the lungs).

The key to prolonging survival with mesothelioma is finding medical professionals who are experienced with the asbestos connection and understand how the symptoms can be mistaken for other diseases and conditions.

Another important consideration is to speak with a qualified mesothelioma trial attorney who can help you review your history and determine whether you might be able to recover compensation for your suffering. Hendlerlaw is a mesothelioma asbestos law firm that specializes in helping victims---at no cost---decide if it might make sense for them to file their own mesothelioma lawsuits. Our fees come only if there is a settlement or award. Please call us with any questions or concerns. We are available 24/7 at 800.443.6353.

Detroit City Managers Admit Ignoring Asbestos Laws

Tuesday, April 20, 2010 by Scott Hendler
When they scheduled to tear down some old homes in Detroit, city officials decided to ignore the risks of asbestos during the project. When released through breaking or crushing asbestos-containing materials, the fibers can get stuck in human lungs and eventually cause mesothelioma, a rare but deadly form of lung cancer. Officials knew that federal laws require buildings scheduled for demolition to be tested for asbestos ahead of time.

What does asbestos look like? It's very hard to identify unless you're an expert. This fire- and heat-resistant material is made up of tiny fibers that are embedded in building and other materials that have been used for many decades. You might find it in insulation, textured paint, stove-pot pads, vinyl floors, electric stoves, materials used to insulate hot water and steam pipes, and in the cement used in roofing and siding shingles.

Asbestos use for commercial buildings was not banned in the U.S. until 1989. So any time an older structure is being torn down, there is danger that asbestos may be hidden in some of the materials. Since asbestos is the only known factor among mesothelioma causes, you can be putting yourself, your family, and your neighbors at risk by breaking down those materials and releasing the asbestos fibers. If you have crumbling insulation around pipes in your basement, for example, call as soon as possible for a professional asbestos risk assessment. Do not attempt to handle the situation on your own.

Asbestos Dangers Date Back Thousands of Years

Wednesday, April 7, 2010 by Scott Hendler
The list of mesothelioma causes is short: asbestos exposure is the only known factor positively associated with developing this unusually aggressive form of lung cancer.

Asbestos has been used for generations because of its heat resistant and fire retardant properties. Evidence of its usefulness was recorded very early in history. A quote from an environmental chemistry website talks about just how early asbestos was used:
"It is possible to trace written documentation of the use of asbestos back to the days of the Roman Empire. However, evidence of the use of asbestos in pottery and chinking of log homes dating back [to] 3000 BC has been found archaeological digs in Scandinavia."
And evidence of the dangers was recorded almost as early. In Roman times Pliny the Elder was only one sage who noticed that those who worked with asbestos had more than usual health problems. He specifically noted that they had lung and other problems (cachexia---wasting away---and abdominal fluid retention) and tended to die at young ages. He even went so far as to design a respirator out of of transparent bladder skin and suggested asbestos workers wear one as protection.

Knowing that humankind has been well aware of the hazards of asbestos for this long makes it even more incredible that companies as late as the 1970s were failing to share the truth with workers and not providing adequate protections.

If you're suffering the symptoms of mesothelioma, talk to one of our experienced attorneys about the possibility that you may be able to collect compensation for your suffering. We are here to help you, 24/7. Please call us at 800.443.6353.

Talk to an Expert About Carboplatin Side Effects

Monday, March 29, 2010 by Scott Hendler
When chemotherapy is recommended for mesothelioma lung cancer patients who've undergone surgery to remove tumor tissue, it's usually a mix of drugs. One drug sometimes used---one that's long been used for head, neck and ovarian cancer---is called carboplatin. Side effects are of many types, though may often be less intense than with a sister drug called cisplatin. Some can be serious, others less so.  Loss of blood cells, especially white cells, is one of the most common side effects of using carboplatin. Don't leave the decision about this critical treatment to a non-expert.

When you're looking for mesothelioma advice of any kind, you want it to be accurate and to come from trustworthy sources. That's why it's important to find a doctor who's experienced with this tricky-to-diagnose, tough-to-treat disease. Despite occasional information to the contrary, mesothelioma causes boil down basically to asbestos exposure. If a medical professional doesn't realize that and is not familiar with the stages mesothelioma tends to follow, you could receive a wrong diagnosis. Or you might receive a correct one eventually, but too late to use some of the more aggressive therapies to fight it. And researchers are constantly working to improve the knowledge base about this fast-moving killer disease, so a doctor who can offer you the very best of current knowledge must be keeping up with the research.

In the same way, it's hard to know what is good mesothelioma legal advice. If you end up with an attorney who bases your case on general personal injury principles, you're not receiving the best possible representation. But if you speak with a qualified mesothelioma cancer attorney, you'll get an evaluation of your history that will give a clear indication of whether you may have a reasonable chance to win compensation for your suffering with this disease. Follow these important tips for choosing a mesothelioma trial attorney.

Review the other sections of the Mesothelioma Advice site for more helpful resources. And don't hesitate to call us with any questions on any aspect of the legal process for filing a mesothelioma lawsuit.

Mesothelioma Causes Point to Asbestos

Saturday, March 27, 2010 by Scott Hendler
If you are a smoker and become exposed to asbestos fibers, your chances of developing asbestosis and other types of cancers increase dramatically. The one disease that has not been shown to occur more often in smokers is the aggressive lung cancer known as mesothelioma. However, mesothelioma causes are limited and include asbestosis itself. As of today, that and asbestos exposure are the only known sources. And if you have mesothelioma, smoking can only worsen your symptoms.

But whatever causes your mesothelioma, you have a right to competent medical treatment. Be aware that many doctors are not familiar with the disease, so if you have any hesitation about your doctor's knowledge on the subject, check elsewhere for one who specializes or look for a nearby mesothelioma lung cancer treatment center. Read our tips for choosing your care team.

And if you have received a mesothelioma diagnosis, you will want to speak with a qualified mesothelioma cancer attorney about the possibility of recovering compensation for your suffering and medical bills. We are happy to walk you through a history of your possible exposure and help you decide--at no charge to you--if it may make sense for you to file a mesothelioma lawsuit. Call us at 800.443.6353.

Texas School Demolition - Asbestos Risk

Thursday, March 11, 2010 by Yahaira Quezada

There is a battle under way in Beaumont, Texas.  The Beaumont Independent School District voted last November to tear down the South Park School, used as a middle school until last year.  In response, more than 2,600 residents in the city of 110,000 signed a petition urging the school district to consider alternate plans for adaptive use.  The fate of this 1922 building is important to the safety and health of the community.  The demolition of this building could prove to be very dangerous because of the tons of asbestos containing materials it harbors.
Removal of asbestos must be done under special procedures.  Asbestos removal must be done prior to demolition to keep the material from becoming airborne.  Inhaled asbestos fibers can cause serious health problems including mesothelioma, a deadly form of lung cancer. Mesothelioma is a rare but aggressive cancer and it is caused almost exclusively by exposure to asbestos.  There is no cure for Mesothelioma.

The district is still in the midst of selecting a company to hire for the project, and will factor in the company's bid and prestige into their decision.  It is in everyone’s best interest that the right company and correct procedures in removing the asbestos are used.  Incorrect removal can expose many people to asbestos and a wave of asbestos lawsuits against the Beaumont Independent School District and others.  Of course, if a child or school official is diagnosed with mesothelioma, the affected parties should consult a mesothelioma asbestos law firm for legal advice.

Because of the nature of the disease and the law surrounding asbestos, mesothelioma litigation is very specialized and complex. It is important that the affected parties consult a mesothelioma cancer attorney. HendlerLaw, a specialized mesothelioma cancer law firm has successfully litigated many asbestos lawsuits. For more information, or help dealing with mesothelioma litigation, call us at 1-800-443-6353, or visit www.mesothelioma-advice.org or www.Hendlerlaw.com

Mesothelioma Symptoms Unpredictable -Choose Your Doctor Carefully

Friday, March 5, 2010 by Scott Hendler

Malignant peritoneal (abdominal) mesothelioma is a very difficult disease that can involve  many different sites in the body. Its main known cause is asbestos exposure, and sources may include unsafe work environments, living near a source or mining or manufacturing, or living with someone who is exposed to asbestos elsewhere.

A recent study was designed to assess the various ways in which symptoms of mesothelioma unpredictably appear in various patients. Patients almost always had ascites (fluid buildup), abdominal pain, breathlessness and fatigue, weight loss, loss of appetite, abdominal mass, fever, diarrhea and vomiting in some combination and in different intensities.

Tumors were found  in a surprisingly wide range of locations. Some patients were found to have colorectal cancer. Others had developed cancer of the cheek, the testes, the tongue, bladder or thyroid.

Even some of the standard tests, such as fluid diagnosis,  did not uniformly reveal that the person had mesothelioma, though they did indicate malignancy.

In short, this dread disease can come disguised as dozens of other conditions. That’s why it’s so important to exercise extreme caution when choosing your doctor and choosing your medical care team.  They must be knowledgeable about this condition and willing to work with you as long as necessary to determine the correct diagnosis…because early detection is critical for you to receive the best possible treatments. Don’t be satisfied with less than total dedication to your case.

And if you receive a mesothelioma diagnosis,  consider calling a mesothelioma cancer attorney knowledgeable about this deadly disease, to find out what your rights may be to hold the manufacturers and users of asbestos responsible for damages.

And just as with your care team, don’t be satisfied with less than
total dedication to your case. If you have any questions at all, don’t hesitate to call us. 800.443.6353. or go to www.Hendlerlaw.com for more information.

What Causes Pericardial Effusion?

Thursday, March 4, 2010 by Scott Hendler
Pericardial effusion is the term used to describe when there is an abnormal buildup of fluid around your heart--literally between the space that encloses your heart (pericardium), the lining of your heart, and your heart itself.

There are many potential pericardial effusion causes. Some are manageable and others are much more serious, so it's critical to have an expert medical  opinion. Some causes include infections, heart surgery, kidney failure, and some types of cancer, including mesothelioma, a particularly aggressive form of lung cancer. Mesothelioma causes are generally limited to previous exposure to asbestos fibers.

You may have no symptoms at all, but if you have one of the conditions that may cause a pericardial effusion--such as mesothelioma--you will want to keep a close watch on your health and keep in touch with your physician. This condition can progress rapidly and potentially cause problems with your heart, so make sure your doctor is familiar with the disease.

If you have mesothelioma and would like to find out about the possibility of recovering compensation, please call one of our mesothelioma cancer attorneys. We are happy to answer any of your questions about what's involved in conducting mesothelioma litigation. You can reach us any time at 800.443.6353.
