W.R.Grace must reveal evidence in Libby asbestos trial
In a stunning reversal, the U.S. Court of Appeals overturned the District Court’s ruling that had allowed W. R. Grace to keep certain key documents out of evidence at its trial. The case is an indictment for criminal negligence in deliberately not telling employees about the dangers of the asbestos-laden vermiculite they were working with at its Libby, Montana plant.
The earlier ruling had also held that expert witnesses would not be allowed to see certain materials and that asbestos would be more narrowly defined.
During the time the trial was delayed by the previous ruling, two people who were important to the case died. One of them was a key witness and resident of Libby who died of mesothelioma, and the other was a defendant in the case–a former general manager of the Libby mine that is the scene of the criminal conduct.
